1. Acceptance of Terms

Welcome to Planet Heartland. These Terms of Service ("Terms") govern your access to and use of the Planet Heartland streaming service, investment platform, and related websites, applications, and services (collectively, the "Services"). By creating an account, accessing, or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the Services.

2. Eligibility

You must be at least 18 years old to use our Services. By using Planet Heartland, you represent and warrant that you are of legal age to form a binding contract and are not barred from using the Services under applicable law. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. Accounts & Registration

To access certain features, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for safeguarding your password and for all activity that occurs under your account. Notify us immediately of any unauthorized use at support@planetheartland.com.

4. Streaming Service

Planet Heartland provides on-demand streaming of films and related content. Your subscription or membership grants you a limited, non-exclusive, non-transferable, revocable license to access and view content for personal, non-commercial use.

• You may not download, copy, reproduce, distribute, transmit, broadcast, display, sell, license, or otherwise exploit any content without prior written permission.
• You may not circumvent, remove, alter, or disable any content protection or access controls.
• We may modify, suspend, or discontinue the streaming catalog at any time without notice.

5. Investment Platform

Planet Heartland facilitates investment opportunities in film productions through a registered funding portal. All investment activities are subject to additional agreements, disclosures, and regulatory requirements.

• Investing in film involves significant risk, including the possible loss of your entire investment.
• Past performance of any film or project does not guarantee future results.
• You must review the offering documents, risk disclosures, and any applicable subscription agreements before investing.
• Planet Heartland is not a broker-dealer, investment adviser, or financial planner.

6. Membership & Billing

Membership fees are billed in advance on a recurring basis according to your selected plan. You authorize us to charge your payment method. You may cancel at any time; cancellation takes effect at the end of the current billing period. No refunds or credits for partial months. We reserve the right to change pricing with reasonable notice.

7. Content Standards & Conduct

Planet Heartland is a family-safe platform welcoming all faiths. You agree not to use the Services to:

• Upload, post, or transmit content that is unlawful, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable.
• Harass, abuse, or harm another person.
• Impersonate any person or entity.
• Interfere with or disrupt the Services or servers.
• Use automated systems to access the Services in violation of these Terms.

8. Intellectual Property

All content available through the Services — including films, trailers, logos, text, graphics, and software — is the property of Planet Heartland or its licensors and is protected by copyright, trademark, and other intellectual property laws. The Planet Heartland name and logo are trademarks of Planet Heartland. You may not use them without our prior written consent.

9. Termination

We may suspend or terminate your account and access to the Services at any time, with or without cause or notice, including for violations of these Terms. Upon termination, all licenses granted to you will cease immediately. Provisions that by their nature should survive termination shall survive.

10. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PLANET HEARTLAND AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law principles. Any dispute arising from these Terms shall be resolved exclusively in the state or federal courts located in Texas.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a revised "Last updated" date. Your continued use of the Services after such changes constitutes acceptance of the revised Terms.
